Article 1 (Purpose)

The purpose of these Website Membership Terms and Conditions (the “Terms and Conditions”) is to provide for the cybermall’s and user’s rights, obligations, and liabilities in the use of Internet-related services (hereinafter "service") provided by the official website operated by Paradise Segasammy Co., Ltd. (hereinafter “Paradise City Website”).

Article 2 (Definitions)

  • 1. “Paradise City Website” refers to any virtual place of business, for transacting goods or services, which Paradise City Website has established by use of information & communications equipment such as computers in order to provide users with goods or services (hereinafter "goods"). This term also refers to the operator of cybermall.
  • 2. "User" refers to a member and non-member who access Paradise City Website and receives Paradise City Website’s service in accordance with the Terms and Conditions.
  • 3. ”Member” means “Paradise Rewards Member” who has registered as a member by providing their personal information on the “Paradise City Website” and has continuous access to the information and services from the “Paradise City Website”.
  • 4. "Non-member” refers to anyone who uses Paradise City Website’s services without becoming a member.

Article 3 (Posting, explaining, and amending the Terms and Conditions)

  • 1. Paradise City Website shall post via Paradise City Website’s main (initial) page the Terms and Conditions, company name and CEO’s name, address of place of business (including the place where consumer complaints can be handled), phone number, fax number, email address, business registration number, e-commerce business number, chief Personal Information (personal information) officer, etc. so that users can easily understand them. However, Paradise City Website may have the users view the Terms and Conditions via a linked screen.
  • 2. Paradise City Website, before user’s consent hereto, shall provide material items hereof, such as offer withdrawal, shipping responsibility, and refund terms, via a linked or pop-up page so that users can understand them, and then obtain the user’s consent.
  • 3. Paradise City Website may amend the Terms and Conditions to the extent not violating applicable laws such as the Act on Consumer Protection in Electronic Commerce, Act on Regulation of Standardized Contracts, Framework Act on Electronic Commerce, Digital Signature Act, Act on Promotion of Information & Communications Network Utilization and Information Protection, etc., Door-to-Door Sales Act, Consumer Protection Act, and Customs Act.
  • 4. Paradise City Website, to amend the Terms and Conditions, shall notify via its main (initial) page, from 7 days before the effective date (enforcement date) to the date immediately before the same, the effective date and reason of amendment along with the current Terms and Conditions. However, if the amendment is unfavorable to users, the aforementioned notice period shall be at least 30 days. In that case, Paradise City Website shall indicate a clear comparison of the Terms and Conditions before and after the amendment in an easy-to-understand manner.
  • 5. The Terms and Conditions, when amended, shall only apply to contracts entered into after the effective date, while contracts entered into before the same shall be governed by the pre-amendment Terms and Conditions. However, where a user having entered into a contract informs, during the notice period under Paragraph 3, Paradise City Website that he/she desires to be governed by the amended Terms and Conditions and obtains Paradise City Website’s consent thereto, such Terms and Conditions shall apply.
  • 6. Matters set forth herein and interpretations hereof shall be governed by the Act on Consumer Protection in Electronic Commerce, Act on Regulation of Standardized Contracts, Korea Fair Trade Commission’s (“KFTC”) Guideline on Consumer Protection in Electronic Commerce, and applicable laws or commercial practices.

Article 4 (Provision and modification of service)

  • 1. Paradise City Website shall perform the following.
    • 1) Provide information on goods or services and enter into a purchase contract
    • 2) Other jobs designated by Paradise City Website
  • 2. Paradise City Website, in cases such as unavailability of goods and services or changes in technical specifications, may modify the content of goods or services to be provided under a future contract with a user. In that case, Paradise City Website shall immediately announce, in such location where the content of current goods or services is posted, the content of modified goods or services and the expected date of provision thereof.
  • 3. Paradise City Website, when modifying the content of service to be provided under a contract with a user for reasons such as unavailability of goods and services or changes in technical specifications, shall immediately notify it at such address where the user can be contacted or reached.
  • 4. In the previous paragraph, Paradise City Website shall compensate for the user’s damages unless Paradise City Website proves that it bears no responsibility.

Article 5 (Suspension of service)

  • 1. Paradise City Website may temporarily suspend the provision of service for reasons such as maintenance, replacement, malfunction, and failure of computers and information & communications equipment.
  • 2. Paradise City Website, unless it shows that it bears no responsibility, shall compensate for users’ or third parties’ damages arising from temporary service suspension under Paragraph 1.
  • 3. When unable to provide service for reasons such as a change in the line of business, discontinuation of business, and M&A, Paradise City Website shall notify, in the method set forth in Article 8, the same to users and compensate consumers upon such terms it has originally proposed. However, when having failed to notify compensation criteria, etc., Paradise City Website shall pay or grant users’ points or savings in the form of properties or cash corresponding to such monetary value as recognized by Paradise City Website.

Article 6 (Membership enrollment)

  • 1. A user can become a member at no cost. Application for membership shall be made by entering member information in the Paradise City Website-designated form and then indicating consent to the Terms and Conditions.
  • 2. Unless a user applying for membership under Paragraph 1 falls into any of the following, Paradise City Website shall register such user as a member.
    • 1) Where the applicant has in the past been disqualified for membership under Article 7, Paragraph 3 hereof, unless 3 years have passed after the disqualification under Article 7, Paragraph 3 and Paradise City Website has accepted membership re-enrollment (re-subscription).
    • 2) Where statements in the registration are false, missing, or erroneous.
    • 3) Where it is deemed that membership registration will have material technical difficulties for Paradise City Website.
  • 3. Paradise City Website membership registration shall result in simultaneous membership in PC’s Paradise Rewards, and saving (accumulation) of membership points and by-class benefits of membership shall be provided in accordance with PC’s Paradise Rewards Membership Terms and Conditions.
  • 4. A member shall be at least 19 years of age (as for minors under 19 years of age, his/her legal representative’s prior written consent under Article 4, Paragraph 3, Item C of the Consumer Protection Guideline shall be obtained at the time of becoming a member and placing an order), and only members at least 19 years of age can make a purchase via Paradise City Website.
  • 5. Membership enrollment (subscription) shall be completed when Paradise City Website’s acceptance thereof reaches the user applying for membership.
  • 6. A member, in cases of changes in the Paradise City Website-registered member information, shall immediately notify the changes to Paradise City Website, or make necessary changes, in the method designated by Paradise City Website.

Article 7 (Membership withdrawal and disqualification)

  • 1. A member may at any time request Paradise City Website for cancellation of his/her membership, and upon such request by a member, Paradise City Website shall immediately take measures necessary for the cancellation.
  • 2. In any of the following cases, Paradise City Website may restrict a member’s use of certain services or suspend his/her membership for a certain period.
    • 1) Where a member makes false registrations when applying for membership
    • 2) Where a member fails to make timely payments in connection with such goods and services purchased by use of Paradise City Website
    • 3) Where a member steals another person’s ID and password or such person’s Personal Information
    • 4) Where a member defames or disadvantages another person via Paradise City Website
    • 5) Where a member interferes with a third party’s use of Paradise City Website or otherwise threatens order in e-commerce
    • 6) Where a member posts pornographic materials via Paradise City Website or creates a link to pornographic websites
    • 7) Where a member does an act prohibited by the law or the Terms and Conditions or contrary to public order and good morals, by use of Paradise City Website
    • 8) Where a member otherwise performs an act which intentionally interferes with the operation of the service
  • 3. If the violation defined in Article 2 is committed two or more times or is not remedied within 30 days after the “Paradise City Website” suspends the membership, the “Paradise City Website” may terminate the membership.
  • 4. If the “Paradise City Website” terminates membership, its registration shall be canceled. In this case, the member shall be notified of such cancellation and given an opportunity to respond to the decision at least 30 days prior to the cancellation.

Article 8 (Notice to members)

  • 1. Paradise City Website may notify a member at the email address designated by the member in advance.
  • 2. Instead of sending individual notices to multiple unspecified members, Paradise City Website may post the relevant matter for 1 week or more on Paradise City Website. However, individual notices shall be made for matters which have material impact in connection with member’s transactions.

Article 9 (Consent to Purchase Order & Collection of Personal Information)

1. The “Paradise City Website” users shall place orders using the following or similar methods whereas the “Paradise City Website” shall provide the following information in an easy-to-understand manner:

  • 1) search and selection of products
  • 2) entry of name, address, phone number and email address (or mobile phone number)
  • 3) terms of service, subscription of services that cannot be cancelled, shipping charges and installation cost
  • 4) confirmation of consent to these terms and understanding and rejection of Item 3 above (ex: mouse click)
  • 5) product purchase order, the confirmation of purchase, or consent to the confirmation from the “Paradise City Website”
  • 6) selection of payment option

Article 10 (Entry into contract)

  • 1. Paradise City Website may refuse to accept a purchase offer, under Article 9, falling into any of the following. However, in the case of contracts with minors, Paradise City Website shall inform or notify that lack of legal representative’s consent may allow the minor or legal representative to cancel the contract.
    • 1) Where statements in the application are false, missing, or erroneous
    • 2) Where a minor purchases goods and services prohibited by the Juvenile Protection Act (cigarettes, alcoholic beverages, etc.)
    • 3) Where it is otherwise deemed that accepting the purchase offer will have material operation or technical difficulties for Paradise City Website
  • 2. A contract shall be deemed entered into when Paradise City Website’s acceptance reaches the user in the form of receipt confirmation notice under Article 12 Paragraph 1.
  • 3. Paradise City Website’s acceptance shall include confirmation of user’s purchase offer, availability for sale, information on the correction and cancelation of purchase offer, etc.

Article 11 (Method of payment)

  • 1. Payment for the goods or services purchased on Paradise City Website can be made in any of the following methods. However, with respect to user’s payment, Paradise City Website may not charge any type of fee in addition to the price of goods and services.
    • 1) Fund transfer such as phone banking, Internet banking, and email banking
    • 2) Card payment such as payment with prepaid card, debit card, and credit card
    • 3) Online no-bankbook deposit
    • 4) Payment in electronic currency
    • 5) Cash on delivery (COD)
    • 6) Payment in Paradise City Website-provided points (mileage, etc.)
    • 7) Payment in gift cards contracted (agreed) with Paradise City Website or recognized by Paradise City Website
    • 8) Payment in electronic payment method

Article 12 (Receipt confirmation notice, and modification and cancelation of purchase offer)

  • 1. Where a user makes an offer of purchase, Paradise City Website shall send a receipt confirmation notice to the user.
  • 2. A user having received the receipt confirmation notice, in cases such as discord or disagreement in the parties’ indication of intent, may immediately request modification and cancelation of the purchase offer, and Paradise City Website shall promptly follow the user’s request made prior to shipping.

Article 13 (Supply of goods and services)

  • 1. Paradise City Website, unless there is a separate agreement with a user on the timing of supplying goods and services, shall take necessary measures, such as manufacturing and packing, so that the goods and services can be shipped within 7 days of the user’s offer. However, if Paradise City Website has already received all or part of the payment for goods and services, Paradise City Website shall take the aforementioned measures within 2 business days of receiving the payment. In that case, Paradise City Website shall take appropriate measures so that the user can check the procedure and status of the supply of goods and services.
  • 2. Paradise City Website shall specify the modes of shipping, by-mode payer of shipping charge, by-mode deadline of shipping, etc. concerning the goods purchased by user. Paradise City Website, when failing to keep the agreed deadline of shipping, shall compensate for the user’s damages unless Paradise City Website shows that it bears no responsibility.

Article 14 (Refunds)

  • 1. Paradise City Website, when unable to deliver goods or provide services for reasons such as the goods or services becoming unavailable, shall promptly notify it to the user, and revoke the contract and issue a refund within 3 days of receiving payment for the goods or services in cases where Paradise City Website has received the payment or, in other cases, within 2 days of the date on which Paradise City Website becomes unable to do the foregoing.

Article 15 (Offer withdrawal)

  • 1. A user who has entered into a contract with Paradise City Website for the purchase of goods and services may withdraw his/her offer of purchase within 7 days of receiving the receipt confirmation notice.
  • 2. In any of the following cases, a user who has received goods and services may not request return or replacement thereof.
    • 1) Where, due to the user’s fault, the goods and services have been destroyed, lost or damaged (However, the offer can be withdrawn when packing is damaged while the content of goods and services is checked.)
    • 2) Where, due to the user’s use or partial consumption, the value of goods and services has materially decreased
    • 3) Where, due to the passage of time, the value of goods and services has materially decreased, making resale difficult
    • 4) Where reproduction of goods and services with the same performance is possible and packing of the original goods and services has been damaged
  • 3. In Subparagraphs 2 through 4 of Paragraph 2, unless Paradise City Website has taken measures in advance, such as stating restrictions on offer withdrawal in places which consumers can easily find, a user’s offer withdrawal shall not be restricted.
  • 4. Notwithstanding Paragraphs 1 and 2, if the goods and services are not as labeled or advertised or the contract is not performed as agreed, a user may withdraw his/her offer of purchase within 3 months of receiving the goods and services and 30 days of the date on which he/she become aware or could have become aware of the matter.

Article 16 (Effect of offer withdrawal)

  • 1. Paradise City Website, when having received from a return of goods and services from a user, shall refund the cost of the goods and services within 3 business days. In that case, Paradise City Website, if delayed in issuing the refund, shall pay a delay penalty or liquidated damages based on the rate decided and announced by the Korea Fair Trade Commission (“KFTC”) and on the length of delay.
  • 2. In the aforementioned refund, where the user did pay via credit card, electronic currency, etc., Paradise City Website shall promptly request the operator or company, providing such means of payment, to suspend or cancel invoicing payment for the goods and services.
  • 3. In cases of offer withdrawal, the cost of returning the goods and services supplied shall be borne by the user. Paradise City Website may not claim, against the user, penalty or damages based on offer withdrawal. However, if the goods and services are not as labeled or advertised or if the contract is not performed as agreed, thus resulting in offer withdrawal, the aforementioned cost shall be borne by Paradise City Website.
  • 4. Where the user pays the shipping charge at the time of receiving the goods and services, Paradise City Website shall clearly indicate, in a manner easy for the user to understand, who shall bear such cost in cases of offer withdrawal.

Article 17 (Protection of Personal Information)

  • 1. The “Paradise City Website” shall collect the minimum user information necessary for the execution of the purchase contract.
  • 2. Paradise City Website, in order to collect a user’s personally-identifiable information (“personally-identifiable information”), must obtain such user’s consent.
  • 3. The Personal Information collected may not be used for purposes other than disclosed or designated or provided to, or shared with, a third party without the user’s consent, and Paradise City Website shall be wholly liable for breach of the foregoing, except in the following cases.
    • 1) When the user’s minimum information necessary for delivery (name, address, phone number) is notified to the shipper
    • 2) Where any personal information necessary for statistics, academic research, or market surveys is provided or shared in a form in which a specific individual cannot be identified
    • 3) When necessary for payment for goods and services
    • 4) When necessary for identity verification in order to prevent theft
    • 5) Where it is required by the law
  • 4. Paradise City Website, where it has to obtain a user’s consent under Paragraphs 2 and 3, shall state or notify, in advance, matters prescribed by Article 22, Paragraph 2 of the Act on Promotion of Information & Communications Network Utilization and Information Protection, etc., including chief Personal Information officer’s identity (employer, name, phone number, other contact information), purpose of collecting and using the information, and matters concerning provision of information to third parties (recipient, purpose of providing information, information items provided). The user may at any time withdraw his/her consent.
  • 5. A user may at any time request Paradise City Website for viewing and error-correction of his/her Personal Information held by Paradise City Website, who shall promptly take necessary measures. If the user has requested such error correction, Paradise City Website may not use the Personal Information until the error is corrected.
  • 6. In order to protect Personal Information, Paradise City Website shall specifically designate, and minimize the number of, Personal Information personnel, and shall wholly be liable for a user’s damages arising from loss, theft, leakage, or unauthorized alteration of the user’s Personal Information including credit card and bank account numbers.
  • 7. Paradise City Website, or any third party receiving Personal Information from the former, when achieving the purpose of collecting or receiving the Personal Information, shall promptly destroy the Personal Information.
  • 8. The “Paradise City Website” shall not tick the consent box for the collection and use of personal information in advance. In addition, specific services that are subject to restriction if the user refuses to give their consent shall be specified in detail. The “Paradise City Website” shall not restrict or refuse to provide its services if the user refuses to provide personal information which is not required.

Article 18 (Paradise City Website’s obligations)

  • 1. Paradise City Website may not do an act prohibited by the laws or the Terms and Conditions or contrary to public order and good morals, and shall do its best to continuously, stably provide goods and services as set forth herein.
  • 2. Paradise City Website shall have in place a security system to protect users’ Personal Information (including credit information) so that users can safely use the Internet service.
  • 3. Paradise City Website, when doing an unjustified labeling/advertising act under Article 3 of the Act on Fair Labeling and Advertising concerning goods or services and thereby inflicting damages to a user, shall be liable for the user’s damages.
  • 4. Paradise City Website may not send for-profit or commercial advertising email not wanted by the user.

Article 19 (Member’s obligations concerning ID and password)

  • 1. A member shall be responsible for managing his/her ID and password except in Article 17.
  • 2. A member may not have a third party use his/her ID and password.
  • 3. A member, when becoming aware that his/her ID and password have been stolen or are being used by a third party, shall promptly notify it to Paradise City Website, and if there are Paradise City Website’s instructions, shall follow them.

Article 20 (User’s obligations)

A user may not do the following acts.

  • 1. Make false registrations in making applications or changes
  • 2. Steal another person’s information
  • 3. Alter information posted on Paradise City Website
  • 4. Send or post information (e.g., computer program) other than designated by Paradise City Website
  • 5. Infringe on Paradise City Website’s or a third party’s copyright or other intellectual property rights (“intellectual property rights”)
  • 6. Defame Paradise City Website or a third party or interfere with operation or business thereof
  • 7. Publish or post obscene or violent messages, pictures, or voice, or any other information contrary to public order and good morals
  • 8. Any other act violating the law or deemed by Paradise City Website as inappropriate

Article 21 (Relationship between linking mall and linked mall)

  • 1. Where a superior or higher-ranking mall and a subordinate or lower-ranking mall are connected through hyperlinks including text, picture, and video, the former shall be called a linking mall (website) and the latter shall be called a linked mall (website).
  • 2. A linking mall which announces, in its main (initial) page or a pop-up page appearing at the time of link, that it shall not be responsible for a user’s transactions for goods and services independently provided by a linked mall shall not be responsible for such transactions.

Article 22 (Copyright-holder, and restrictions on copyright use)

  • 1. Copyright and other intellectual property rights for works created by Paradise City Website shall belong to Paradise City Website.
  • 2. Without Paradise City Website’s prior approval, a user may not use any information obtained from use of Paradise City Website and whose intellectual property rights belong to Paradise City Website, for profit and by methods such as reproduction, transmission, publication, distribution, or broadcasting, or have a third party use the same.
  • 3. Paradise City Website, when using a user’s copyright, shall notify it to the user in accordance with the previously set rules.

Article 23 (Dispute resolution)

  • 1. Paradise City Website shall establish and operate a compensation handling organization in order to reflect users’ legitimate complaints and opinions and compensate for their damages.
  • 2. Paradise City Website shall handle user’s complaints and opinions as a priority. However, if expedient handling is difficult, Paradise City Website shall immediately notify the user of the reason and the schedule of handling the same.
  • 3. Where a user applies for damage relief in connection with its e-commerce dispute with Paradise City Website, Paradise City Website may follow the result of mediation issued by a dispute mediation institution appointed by KFTC, mayor, province governor.

Article 24 (Jurisdiction and governing law)

  • 1. Lawsuits concerning e-commerce disputes between Paradise City Website and user shall be subject to exclusive jurisdiction of the district court presiding over the user’s address at the time of filing a lawsuit or, if such address does not exist, over the user’s residence. However, if the user’s address or residence is not clear at the time of filing the lawsuit or if the user resides overseas, the jurisdiction shall be decided by the Civil Procedure Act.
  • 2. E-commerce lawsuits between Paradise City Website and user shall be governed by the law of the Republic of Korea.

Terms and conditions of Paradise Rewards membership (Required)

Paradise Rewards Terms and Conditions

Article 1 (Purpose)

The purpose of these Paradise Rewards Terms and Conditions (hereinafter “Terms and Conditions”) is to set forth matters including Paradise City’s (hereinafter “Hotel’s”) and the members’ rights and obligations, and relevant procedures in relation to services provided to the members of Paradise Rewards (hereinafter “Membership”) operated by the Hotel.

Article 2 (Definitions)

The following terms used herein shall be defined as follows.

  • 1. The term “Paradise Rewards Member” or “Member” refers to any customer having become a member pursuant to the procedure under Article 5 hereof in the Hotel’s premises or official website and authorized to use regular membership service.
  • 2. The term “Paradise Rewards Card,” “Card” or, depending on the context, “Membership Card” refers to the mobile card issued by the Hotel to the members and approved for regular use of the membership service
  • 3. The term “Paradise Rewards Point” or “Point” refers to points which can be accumulated or earned and then used in the purchase of goods and services at the Hotel.
  • 4. The term “Premises” includes any store directly operated by the Hotel (hereinafter “Premises”) and the Hotel’s Internet site (hereinafter “Website”). Premises where membership service can be used may be added or excluded in the future depending on the Hotel’s conditions, and the addition and exclusion shall be notified via the Hotel website.
  • 5. The term “Leased Spaces” refers to any store providing membership service under contract with the Hotel and being operated under a lease contract. Certain leased spaces can be excluded. Details of the leased spaces can be checked on the website.
  • 6. The term “Hotel Website” or “Website” refers to the Hotel’s Internet site where the members can check and use the membership service online.
  • 7. The term “Paradise Rewards Membership Service” or “Membership Service” refers to the overall customer service program provided by the Hotel to the members (point accumulation/use, discount, event participation, etc.).

Article 3 (Effect and amendment of the Terms and Conditions)

  • 1. The Terms and Conditions shall become effective when they are posted on the Hotel website or otherwise notified to a certain individual and such individual consenting to the Terms and Conditions enrolls in the membership service.
  • 2. The Terms and Conditions shall apply to all members intending to use the membership service, including those who are already members of such service.
  • 3. The Terms and Conditions may be periodically amended. The Hotel, to amend the Terms and Conditions due to its internal conditions, shall notify the members of the fact of such amendment, changes made therein, etc. in one or more of the methods below, at least 15 days before the scheduled effective date of amendment. (However, in the case of any amendment that risks being potentially disadvantageous to the members, the notice shall be made at least 30 days in advance.)

    • - Written notice or notice via leaflet
    • - Posting on the premises or leased spaces
    • - Notice by phone at the contact number provided by the member at the time of becoming a member, etc.
  • 4. The Hotel, to transfer its contractual relationship hereunder through business transfer, etc., shall notify it to individual members, and any member who continues to use the membership service for 30 days without raising any objections thereto shall be deemed to consent thereto.
  • 5. The Hotel shall notify the members of the fact of amendment hereof, changes made therein, etc. by e-mail or written notice, at the e-mail addresses provided by the members or the most recent addresses provided, in which case notices shall be deemed duly made.
  • 6. Any member having objections in relation to the amendment may cancel their membership, and if failing to do so or to otherwise raise objections to the Hotel before the amendment becomes effective, shall be deemed to consent to the amendment.

Article 4 (Membership service)

  • 1. The membership service provided hereunder by the Hotel to the members shall be as follows.
    • 1) Accumulation or earning of points
    • A. A member may earn points based on purchase of the Hotel’s goods or services, as a result of an event, etc.
    • B. However, certain goods and services designated due to the Hotel’s internal conditions may be excluded from accumulation of points.
    • C. Membership classes may be adjusted based on the points accumulated
    • 2) Use of points
    • A. A member may purchase goods or services by using the points at the premises or leased spaces in the Hotel. To use points, however, a member must be issued a membership card, and present it when purchasing the goods or services.
    • 3) Discounts
    • A. A member, when purchasing goods or services at the Hotel, may receive a discount on the price of the goods and services pursuant to the Hotel’s membership policy.
  • 2. The membership service provided shall be subject to changes pursuant to the sales policy of the premises and leased spaces in the Hotel.

Article 5 (Enrollment in membership)

  • 1. Enrollment in membership may be conducted on the Hotel website or certain premises.
  • 2. All customers (including foreigners) using the Hotel are eligible for the membership, at no additional cost. (However, a minor may not become a member.)
  • 3. Any customer intending to become a member shall fill out a membership application form (including documented requests) via the Hotel website or certain premises, sign the form, and then consent to the Terms and Conditions and the Personal Information Policy (‘Consent to collection, sharing, and use of personal information,’ etc.).
  • 4. All Paradise Signature members, Paradise Casino members, and Chroma VIP members shall automatically become Paradise Rewards members.
  •  (However, this does not apply to Event Membership Club members.)
  • 5. The members shall comply with the Terms and Conditions, and any member providing false information at the time of applying for membership may be subject to restrictions in their legal protections and the membership service.

Article 6 (Membership cancellation and disqualification)

  • 1. A member may, at any time request, for their membership to be canceled, in writing, by e-mail, by phone, or in any other method designated by the Hotel, in which case the Hotel shall perform the procedure necessary for the cancellation.
  • 2. Where, after use of points, cancellation of the purchase which enabled earning the points renders a member’s points in the negative (below zero), the member may not cancel their membership until repaying the relevant amount. However, if the Hotel’s negligence has affected the cancellation, the membership can be canceled upon the Hotel’s approval.
  • 3. In any of the following cases, the Hotel may suspend or revoke a member’s membership.
    • 1) Where the member makes false registrations or steals another person’s identity, in applying for membership
    • 2) Where the member uses membership service in a wrongful method or for a wrongful purpose (e.g., wrongful accumulation or use of points)
    • A. Wrongful accumulation: Points being accumulated or earned for a member even though the member has not actually purchased goods or services. Where points are erroneously accumulated or earned due to system errors, etc., if the member purchasing goods or services consents to another member’s earning the points, there shall be no wrongful accumulation. (However, if the employee of the premises or the leased spaces is a member, unless they have actually purchased goods or services, the resulting point accumulation shall be deemed wrongful.)
    • B. Wrongful use: Use another member’s points without such member’s consent.
    • 3) Where the member is deceased
    • 4) Where the member violates applicable laws and thereby threatens the order of electronic commerce (e.g., wrongfully interfere with another member’s use of the premises or the website, or steal another member’s information)
    • 5) Where the member breaches their obligations hereunder
    • 6) Where the member interferes with the Hotel’s normal business and operation, thereby inflicting damages
    • 7) Where the member commits an act of intentionally interfering with operation of the membership service
    • 8) Where the Hotel decides that it needs to refuse provision of the membership service
  • 4. A member having been disqualified under Paragraph 3 above may state their opinions within 30 days of receiving the Hotel’s notice, in which case the Hotel shall review the matter and if it decides that the member’s positions are justified, shall take measures so that they can continue to use regular membership service.
  • 5. In the case of membership cancellation under Paragraph 1 above, the following shall apply.
    • 1) Where a member requests cancellation of their own membership, the cancellation shall become final when the Hotel notifies completion of measures thereof.
    • 2) Where a member is disqualified for membership, the disqualification shall become final on the date when the Hotel gives notice thereof.
    • 3) Where a member is disqualified for membership due to their death, the member’s rights, obligations, and points concerning membership service may not be inherited by their heir.
  • 6. In the case of membership cancellation or disqualification, member information shall be handled as follows.
    • 1) A canceled member’s information shall be retained for a period as set forth in Article 15 hereof and then deleted.
    • 2) The information of a disqualified member shall be retained for two years from the disqualification, and during such period, re-enrollment in membership and provision of membership service can be impossible.

Article 7 (Point accumulation)

  • 1. Points may be accumulated or earned when a member purchases goods or services sold by the Hotel or has become a target of marketing activities (e.g., the Hotel-conducted events and promotions, or additional point accumulation).
  • 2. For a member having purchased the Hotel’s goods or services, points shall be calculated and accumulated as follows.
    Accumulated or earned points = (Actual payment made at the time of goods or services purchase (excluding VAT)) X (Point accumulation rate, by class)
  • 3. At certain premises or leased spaces, point accumulation may not be allowed in accordance with the Hotel’s policy.
  • 4. Points shall be automatically accumulated or earned on the date immediately following the payment date.
  • 1) For point accumulation, a membership card under the relevant member’s name shall be presented, in principle.
  • 2) When using the room, point accumulation varies based on membership class.
    • A. RED Membership: 1% of room charge (excluding VAT)
    • B. PURPLE Membership: 2% of room charge (excluding VAT)
    • C. GOLD Membership: 3% of room charge (excluding VAT)
  • 3) When using the food and beverage or leisure outlets in HOTEL PARADISE(“Hotel”) or using the premises or leased spaces in the Hotel, point accumulation varies based on membership class
    • A. RED Membership: 1% of the charge (excluding VAT)
    • B. PURPLE Membership: 2% of the charge (excluding VAT)
    • C. GOLD Membership: 3% of the charge (excluding VAT)
  • 4) Points cannot be earned when a room is booked through a travel agency or as a group.
  • 5) Points cannot be earned when a room is booked through a special contractor.
  • 6) In using the coupons/discounts provided by affiliated cards and vouchers or those provided as membership service, points are earned based on the total payment subtracted by the amount of coupons/discounts and VAT.
  • 7) Out of the points calculated or awarded under Paragraphs 2 and 4 above or additionally earned in the Hotel-conducted events, decimals shall be discarded. And in the payment for the Hotel’s goods and services by use of means such as points, affiliation points, gift cards, meal vouchers, room vouchers, mobile coupons, and membership coupons, not cash or credit cards, points may not be accumulated or earned.
  • 8) Points cannot be earned for the amount paid by admission tickets, vouchers, gift cards, etc. purchased through sales agents or third parties.
  • 9) A member shall request point accumulation immediately upon purchase of the Hotel’s goods and services in principle, but as for their own purchase only, may request retroactive accumulation by presenting the purchase receipt within 30 days of the purchase. The Hotel, under its internal policy, may change the period for requesting the retroactive accumulation, and depending on the circumstances, may refuse a member’s request for retroactive accumulation.
  • 10) Point accumulation rate and accumulation criteria are subject to changes at the discretion of the Hotel in accordance with its internal policy.
  • 11) A member may check the accumulated or earned points after becoming a member and logging in to the Hotel website.
  • 12) Items not eligible for point accumulation
    • A. Payment to leased spaces, annual membership fee, banquet hall rental fee
    • B. Meeting room rental fee, valet parking fee, cigarette, parking fee
    • C. Room charge in excess of 5 rooms a day, room phone charge, and other incidental expenses to use of rooms
    • D. Class fee and equipment rental fee
    • E. Promotional items and purchase goods designated by the premises or the leased spaces
    • F. Payment made before becoming a member
    • G. Payment for special-price room packages
    • H. Payment in purchases made by vouchers (gift cards, room vouchers, meal vouchers, etc.)
    • I. Payment for F&B at ART HOUSE

Article 8 (Use of points)

  • 1. In order to use points, a member shall acquire membership by applying for it and present a membership card under their name. And to use points worth a certain amount, they shall enter their password. Points accumulated or earned for a member (hereinafter “available points”) shall be spent on first-in-first-out basis.
  • 2. Minimum usable points and the unit of point use shall be designated by the Hotel, and use of points shall be notified in the premises or leased spaces in one or more methods (including oral notice). Points may be used after accumulation of 3,000 points as 1 unit point each regardless of the amount of points used.
  • 3. Points may only be used in the Hotel-designated premises and leased spaces.
  • 4. Points may not be transferred, loaned or used as security
  • 5. The same points may not be used by two or more persons or used multiple times, and two or more persons’ points may not be combined in payment for a single bill.
  • 6. In a member’s purchase of goods and services, discounts and points may apply simultaneously, but when other discounts are available for them, double discounts shall not be allowed and the highest discount rate shall apply.

Article 9 (Correction, cancellation and expiration of points)

  • 1. Where there is an error in a member’s accumulated or earned points, the member shall request the Hotel for correction within 30 days of the occurrence of error, and the Hotel shall complete the correction within three months of such request. If necessary, the Hotel may request the member to present any objective evidence (e.g., receipt) which can prove the error.
  • 2. Points are valid for of 24 months from the date points are earned, and shall automatically expire.
  • 3. The Hotel, when revoking a member’s points whose expiry date has arrived, shall notify related matters such as the points about to expire and the time thereof, by email or SMS at least 15 days in advance.
  • 4. A member may check, in the Hotel website, the points about to expire and those having already expired.
  • 5. The expiry date of the points awarded by the Hotel to a member as a result of marketing activities (e.g., events and promotions), not points accumulated from purchase of the Hotel’s goods and services, may be separately designated in accordance with the Hotel’s policies and internal conditions, and shall be separately notified to the members.
  • 6. Where the payment for a member’s purchase of goods and services is refunded, the points accumulated or used shall be canceled or restored.
  • 7. For a member intending to cancel their membership as set forth in Article 6 Paragraph 1 hereof to use the remaining points, they shall use, as set forth herein, the available points accumulated until the member-requested date of cancellation.

Article 10 (Membership classes and benefits)

  • 1. Adjustments to the membership classes are categorized into upgrade, no change, and downgrade.
  • 2. Membership class shall be evaluated and adjusted every three months (quarterly). Membership class evaluation and adjustment shall be made within three business days during the first week of January, April, July, and October each year. Benefits as a result of the adjustment may be used for one year afterward.
  • 3. The membership class evaluation shall be determined, based on the points accumulated according to the method described on Article 7 (2) of the Terms and Conditions, and points earned under other circumstances shall not be taken into account for the membership class adjustment.
  • 4. Benefits according to the membership class, if not used before the expiry date, shall automatically expire, and may not be revived or renewed (extended in period).
  • 5. All benefits are embedded in the membership card, and the membership card shall be presented for use of the benefits.
  • 6. All benefits are available only to the registered member and at no time shall be permitted for transfer to any other party.
  • 7. RED Membership benefits
    • 1) At the completion of the initial membership enrollment, the member shall be registered a “RED member.”
    • 2) The following benefits shall be provided to RED members
      • A. F&B outlets in the Hotel: 5% discount.

  • 8. PURPLE Membership benefits
  • 1) Members will be upgraded to PURPLE Membership upon accumulation of 50,000 points or more in two years (24 months) from the time of class evaluation. PURPLE Membership can be maintained over the following 12 months.
  • 2) The following benefits shall be provided to PURPLE members.
    • A. F&B outlets in the Hotel: 5% discount.

      • b. Not available during: Year-end holiday season (12/29 - 12/31). Specific dates subject to changes each year.
      • c. Not eligible for performances by well-known overseas DJs.
      • d. A discount or point accumulation rate is applied for any amount that is not covered by the voucher.
      • e. If the premises are not in operation for 30 or more days, then the complimentary passes for regular performances at CHROMA shall be replaced by points, and 20,000 points shall be awarded per pass.
    • M. Two WONDERBOX one-day passes
      • a. One person per pass.
      • b. Not available during: Holidays, peak season (late July - early August, 12/24), and year-end holiday season (12/29 - 12/31). Specific dates subject to changes each year.
      • c. Use may be restricted based on facility conditions.
      • d. A discount or point accumulation rate is applied to any amount that is not covered by the voucher.
      • e. If the premises are not in operation for 30 or more days, then the WONDERBOX one-day passes shall be replaced by points, and 30,000 points shall be awarded per pass.
  • 9. GOLD Membership benefits
    • 1) Members will be upgraded to GOLD Membership upon accumulation of 150,000 points or more (in two years (24 months) (from time of class evaluation). GOLD Membership can be maintained over the following 12 months.
    • 2) The following benefits shall be provided to GOLD members.
      • A. F&B outlets in the Hotel: 10% discount.

        • c. Use may be restricted based on facility conditions.
        • d. A discount or point accumulation rate is applied to any amount that is not covered by the voucher.
        • e. If the premises are not in operation for 30 or more days, then the WONDERBOX one-day passes shall be replaced by points, and 30,000 points will be awarded per pass.
      • O. Two long-term (1 week) parking passes
        • a. Free parking for up to seven days (one week, 168 hours) from initial parking
        • b. After seven days (168 hours), parking fee of 24,000 KRW will be charged per day.
      • P. The Hotel’s complimentary welcome amenity will be provided during guest’s stay
        • a. Shall be limited to the room the actual member stayed.

Article 11 (Member’s rights)

  • 1. Accumulated or earned points shall be indicated at the bottom of the receipt when purchase of the Hotel’s goods and services is made. A member can also check the points via the website or by phone through the Hotel & Resort Membership Desk.
  • 2. A member has the right to inquire the Hotel about the benefits and points of the membership. And the Hotel may notify the members of any updates or changes to the programs through appropriate means. In the case of written notices, the Hotel shall not be liable for the members’ damages caused by loss or delay in the notice.

Article 12 (Termination of membership service)

  • 1. The Hotel reserves the right to terminate membership service for its own sound operation.
  • 2. The last day of membership service shall be determined at the Hotel’s discretion. The Hotel may terminate membership service due to its conditions by notifying the members six months in advance by e-mail, by SMS, in writing, or on the website.
  • 3. The members shall not be entitled to membership service or benefits past the termination date. Points must be used by the date designated by the Hotel; any unused points by such date shall automatically be forfeited.

Article 13 (Collection of personal information)

  • 1. The Hotel may periodically collect and retain not only personal information provided by a member in applying for membership or occurring from the use of membership service but also that obtained with the member’s prior consent, and may use the same for marketing activities to provide better services to the members based analysis thereof. Details on the collection and use of personal information shall follow the ‘Personal Information Policy (Consent to collection and use of personal information)’ contained in the Hotel website or its membership application form.
  • 2. The Hotel, when collecting personal information, obtains from the member the ‘consent to collection and use of personal information’ in a designated form, and the member may at any time withdraw the consent.
  • 3. A member, in cases where there are changes in the personal information provided to the Hotel, shall promptly notify it to the Hotel, and the Hotel shall not be liable at all for the damages caused by failure to notify the same.

Article 14 (Use and sharing of personal information)

  • 1. The Hotel shall only share the collected personal information with third parties stated in the ‘Personal Information Policy,’ only use the same for the purposes stated therein, and may not use the collected personal information for other than the stated purposes without the member’s consent or share with any third parties not stated therein. In violation of the foregoing, all liabilities therefore shall be borne by the Hotel.
  • 2. The following are exceptions to the above.
    • 1) Where, for shipping, minimum member information (name, address, phone number) is notified to the shipping company
    • 2) Where any personal information necessary for statistics, academic research or market activities is shared in a form wherein a specific individual cannot be identified
    • 3) Where necessary for payment in transactions
    • 4) Where unavoidable under the law
    • 5) Where, in cases of merger, acquisition, or comprehensive business transfer, personal information is shared with the post-merger surviving company, acquiring company, or business transferee
  • 3. The Hotel, to share a member’s personal information with a third party, shall notify all of the following to the member and obtain their consent thereto, except for cases falling under Paragraph 2 above.
    • 1) Personal information recipient
    • 2) Personal information recipient’s purpose of using the personal information
    • 3) Personal information items to be shared
    • 4) Period of personal information recipient’s retention and usage of personal information
    • 5) The member’s right to refuse to give consent and, in cases where the refusal entails disadvantages, the content thereof

Article 15 (Period of retention and usage of personal information)

  • 1. The Hotel, when the purpose of collecting a member’s personal information is achieved, shall promptly destroy the personal information in principle. In any of the following cases, however, it may retain the collected personal information in whole or in part for certain periods, as an exception.
    • 1) For purpose of handling customers’ requests: Retention of the collected personal information for 30 days after the membership cancellation
    • 2) Where the Hotel obtains a separate consent as necessary: Retention of the collected personal information to the extent (member information, and period of retaining the same) consented to
    • 3) Where investigation of accidents, resolution of disputes, handling of complaints, or performance of legal obligations related to the purpose of using the personal information is necessary: Retention of the collected personal information to the extent necessary
  • 2. If applicable laws such as Commercial Act and the Act on Consumer Protection in Electronic Commerce, Etc. require that the foregoing shall be retained for certain periods, the Hotel may retain member information for periods under applicable laws or for the following periods.
    • 1) Records on contract, offer withdrawal, etc.: 5 years
    • 2) Records on payment and on supply of goods and services: 5 years
    • 3) Records on handling of consumers’ complaints or disputes: 3 years

Article 16 (Member’s rights for protection of personal information)

  • 1. A member reserves the right to withdraw, through membership cancellation, their consent to collection and use of personal information related to the Terms and Conditions. In that case, the Hotel may only retain member information pursuant to Article 15 hereof.
  • 2. A member may ask to view their personal information held by the Hotel, and if there is an error in the personal information, may take measures through the Hotel website, or request correction against the Hotel & Resort Membership Desk or the personnel in charge of personal information protection.
  • 3. When requested by a member for viewing and correction of personal information as stated above, the Hotel shall promptly take necessary measures.

Article 17 (Personal information-processing contractors)

  • 1. The Hotel shall itself perform processing and management of the collected personal information in principle, but if necessary, may hire a contractor to perform the foregoing in whole or in part. The Hotel shall state information on the personal information-processing contractor and other details on its website or the membership application form.
  • 2. The Hotel provides for necessary matters in the contracts with personal information-processing contractors, so that the personal information can be safely managed pursuant to applicable laws.

Article 18 (Processing of personal information)

  • 1. The Hotel, so that the members can safely use the membership service, shall endeavor to build and operate a security system to protect the members’ personal information.
  • 2. The Hotel shall designate the personal information usage period as follows, and separately store/manage or destroy the relevant member’s personal information after expiry of the usage period from the time of final use.
    • 1) Usage period: One year (However, if any member, at the time of applying for membership, expressly requests that the personal information usage period shall be until the time of ‘membership cancellation,’ the personal information usage period for such member shall be until such time.)
    • 2) Usage of personal information : Use of membership service (member verification, website login, point checking, point accumulation, point use, point adjustment, point conversion, etc.), issuance of membership card, purchase of the Hotel’s goods and services, revision of information, etc.
    • 3) After expiry of the usage period: Separate storage and management
      • A. Separate storage and management: As a measure comparable to destruction of personal information, store and manage long-term dormant members’ personal information separately from active members’ personal information DB, and restrict access by ordinary employees.
      • B. Notice of expiry of usage period: Notify the fact and date of personal information being destroyed or separately stored, and personal information items to the relevant member, by e-mail, SMS, etc. at least 30 days before expiry of the usage period.
      • C. If, after expiry of the usage period, a member uses the membership service, it shall be deemed as a request (for re-use) and restored from the state of separate storage/management to that of regular use.

Article 19 (Website)

  • 1. In order to use the website service, a member shall enroll via the website specified in Article 2 Paragraph 6 hereof, pursuant to the procedure prescribed by the Hotel.
  • 2. The Hotel performs the following to provide the membership service through the website.
    • 1) Provide information related to the membership service (e.g., check the accumulation, use, and expiration of the member’s points, revise personal information, and participate in events)
    • 2) Revise and correct member information
    • 3) Other matters prescribed by the Hotel
  • 3. In any of the following cases, the Hotel may restrict or suspend the provision of the website service in whole or in part, but when restricting or suspending use of the service, shall notify the reason and period thereof to the members by e-mail, by SMS, or via the website.
    • 1) Where it is unavoidable (e.g., inspection, repair, replacement, and malfunction of information and communications equipment)
    • 2) Where use of regular service is disrupted due to power failure, equipment malfunction, traffic congestion, etc.
    • 3) Where the Hotel cannot continue to provide service due to its internal conditions
    • 4) Where there are force majeure events
  • 4. A member shall be responsible for managing their own member ID and password created through the website, and may not divulge to, or share with, a third party, the member ID and password.
  • 5. A member, when becoming aware that their member ID and password have been stolen or are used by a third party, shall immediately notify it to the Hotel. The Hotel shall not be legally liable for the member’s damages occurring from theft, not at the Hotel’s fault, of their information.

Article 20 (Resort’s obligations)

  • 1. The Hotel shall continue to endeavor to provide stable, continuous membership service as set forth herein.
  • 2. In relation to the collection and use of the members’ personal information, the Hotel shall comply with the ‘Personal Information Policy’ consented to by the members.
  • 3. Where a member’s opinion or complaint is deemed justified, the Hotel shall promptly resolve the matter.

Article 21 (Liabilities for breach of the Terms and Conditions)

  • 1. All liabilities for breach of the Terms and Conditions shall be borne by the breaching party, who shall compensate for any damages incurred by the other party.
  • 2. The Hotel shall not be liable for any member’s damages related to use of the membership service and caused by the member’s intent or negligence.

Article 22 (Interpretation and jurisdiction)

  • 1. The membership service is for the benefit of the Hotel’s customers. Considering the free membership service provided by the Hotel, members must consent that the Terms and Conditions reflect the Hotel’s conditions and positions.
  • 2. Matters not set forth herein and the interpretation hereof shall be governed in accordance with the laws of the Republic of Korea and commercial practices.
  • 3. All disputes and lawsuits related to use of the membership service hereunder shall be resolved in the court presiding over the member’s address, and if the member has no address, shall be subject to exclusive jurisdiction of the district court presiding over the residence. However, if a member’s address or residence is not clear at the time of filing the lawsuit or in cases of an overseas resident, the lawsuit shall be filed in the jurisdictional court under the Civil Procedure Act.

Consent to the collection and use of mandatory personal information (Required)

Paradise City is committed to protecting your personal information. In order to provide services, we require your consent in accordance with Articles 15 and 22 of the Personal Information Protection Act.

1. Purpose of collection and use: user verification for membership service, customer notification and complaint handling

2. Information subject to collection

  - Required information: username, password, name, date of birth, mobile phone number, email address

  - Optional information: address, profession, wedding anniversary date, facilities of interest, areas of interest

3. The following rules apply to the personal information of inactive users and upon expiration of retention period counted from the last access, the personal information shall be stored/managed separately or destroyed:

  1) Valid for 1 year

  2) Applicable services: membership service (user verification, website login, view/credit/redemption/adjustment/conversion of reward points), card issuance, purchase of hotel products and services, updating information

  3) After expiration: to be managed or stored separately

    a. separate storage and management: As part of a measure equivalent to destruction, the personal information of inactive users shall be stored/managed separately from the database containing other users' personal information and unauthorized access is restricted.

    b. notification of pending expiration: members shall be notified of destruction or separate storage/management of personal information via email or text message at least 30 days prior to expiration, including the date and types of information.

    c. If inactive members use the service, it shall be considered a request to re-activate the account and their personal information shall be restored for normal storage/management.

4. Personal information shall be destroyed when the purpose of collection and use is achieved in accordance with Article 2 of the Privacy Policy or if requested by the member during the retention period or at the   point of destruction. However, personal information shall be retained under the applicable laws and regulations in the following events:

  - Period of retention/use: from the date of membership registration to the withdrawal of membership

  - Applicable laws: Commercial Act, Act on the Consumer Protection in the Electronic Commerce Transaction, etc.

  - Period of retention

    ㆍWithdrawal of subscription or contract: 5 years

    ㆍInformation about payment and product supply: 5 years

    ㆍHandling complaints or disputes with consumers: 3 years (Act on the Consumer Protection in the Electronic Commerce Transaction, etc.)

    ㆍCollection and use of credit information: 3 years (Credit Information Use and Protection Act)
In the event of outstanding payment or overpayment, the information shall be retained until the case is resolved.

5. You may refuse to consent to the collection and use of personal information. However, in this case, you may not be able to register as a member.
